1. What these terms are for
They set the rules between the publisher of Orkalo (“we”) and the person or company that creates an account or a workspace (“you”). By ticking the box when signing up, or by continuing with Apple or Google, you accept them in their current version; that version and the date are recorded with your account.
2. Words used
- Workspace: all your properties, bookings, teams and settings (yours, or your concierge company's).
- Customer: the holder of the workspace, who takes out the subscription.
- Member: a person invited into a workspace (team, owner).
- Service provider: a person who carries out a job (cleaning, maintenance), with an account or through a personal link without an account.
- Guest: the customer of a booking.
- Platform: a booking channel connected to Orkalo (Airbnb, Booking.com, Localoge…).
3. Your account
You provide accurate information and keep it up to date. Your login details are personal: you are responsible for what is done with them and you let us know straight away if you think someone else has used them. The holder of a workspace decides who joins it and with which rights. You can delete your account at any time from My account, on the website as well as in the apps.
4. What Orkalo does
Orkalo helps you manage your properties and bookings, synchronise calendars and prices with connected platforms, organise jobs, talk to guests and produce your documents (contracts, quotes, invoices, statements).
Synchronisation also depends on the platforms and on the technical intermediary that connects us to them: a delay or outage on their side can hold up an update. You remain responsible for your listings, prices and rules and for your relationships with guests and owners. The document templates provided are examples to adapt to your situation.
5. Connection to platforms
The connection to Airbnb, Booking.com and the other platforms goes through a technical provider, named in the privacy policy. To link a listing, you authorise Orkalo and this provider to act on your platform account (calendar, prices, bookings, messages).
These platforms are not ours: they set their own rules, fees and limits, may change them, suspend an account or a listing, or cut an access, and we cannot prevent it. We do not guarantee their availability, how long a connection lasts, or that a feature they offer will be reproduced in Orkalo. You remain bound to each platform by its own terms, which you must follow.
6. Your obligations
You alone are responsible for what you offer for rent: accuracy of listings, photos, prices, availability, house rules. You follow the rules of each connected platform and the regulations that apply to your activity: registration with the town hall or a registration number for the property, night caps, building or lease authorisations, taxes, collecting and paying over tourist tax, guest registration for foreign travellers, safety of the property. When Orkalo helps you calculate or track these items, it is an aid, not legal or tax advice.
The contracts, quotes, invoices, statements and template messages Orkalo generates for you are generated in your name: you check their details (identity, VAT, terms, prices) before sending them; their content is your responsibility. You inform your service providers, including those who work without an account through a personal link, about how their data is used, in particular the geolocated clock-in.
7. Free trial
A free trial starts automatically when a workspace is created, with no bank card. All features are open during the trial. One trial per workspace. At the end of the trial, without a subscription, the subscription features stop; your data is kept for 30 days so you can subscribe or export it. After that, the data of a workspace without a subscription is deleted within 90 days.
8. Plans and prices
The price depends on the number of active properties in the workspace, following a continuous formula: €14.99 for the first property, then €3.00 per additional property, per month; beyond 200 properties, the plan is set by custom quotation. Current prices are always shown on the Orkalo website, on the pricing page (live calculator) and on the Subscription screen of the website (where the subscription is managed). With yearly billing, you pay 10 months for 12, at the exact price. Prices are shown tax included; at present VAT is not applicable (art. 293 B of the French Tax Code), so tax-included equals excluding tax. If your number of properties changes, the price follows automatically, with no tier to cross; the difference is prorated by our payment provider. Distribution to the Localoge platform does not require a separate subscription. Messaging and reviews are always included. If the publisher became subject to VAT, it would be added to your prices with 30 days' notice; for a VAT-registered business established in the European Union, reverse charge applies where relevant. Orkalo is aimed at professionals and hosts; if you act as a consumer, your statutory rights still apply, and the free trial lets you try it without commitment.
9. Paying for the subscription
The subscription is paid by bank card, in advance, monthly or yearly. Payment is handled by a specialised provider; we never see or keep your card number. An invoice is available for every payment. If a payment fails, we let you know; if it is not settled, access to subscription features may be suspended.
Nothing is purchased in the iPhone, iPad or Android apps: the subscription is taken out, changed and cancelled only on the website. The subscription renews automatically at each due date (monthly or yearly) until you cancel it. A price change only applies to your running subscription after the notice described in the "Changes" article.
10. Cancellation
You can cancel at any time from the Subscription screen on the website. Cancellation takes effect at the end of the period already paid; until then, everything keeps working. A period that has started is not refunded, unless the law requires otherwise. Before the end, you can export your data (bookings, guests, documents).
We may suspend or close a workspace in case of serious breach of these terms (fraud, unlawful use, persistent non-payment), after warning you except in an emergency. After the subscription ends you have 30 days to export your data; the workspace and its data are then deleted within 90 days, except what the law requires us to keep (accounting records). We may also suspend access if a platform or a payment provider requires it for a legal reason.
11. Money from your bookings
Orkalo does not collect any money on your behalf. When you offer a guest an online payment (payment link, deposit, security deposit, extra), the payment is handled by a third-party payment provider under its own terms, which you accept when you enable it. Payments made on Airbnb, Booking.com or another platform remain governed by that platform.
12. Your content and your data
What you add (properties, photos, texts, messages, documents) remains yours. You allow us to use it only to run the service: display it, store it, send it to the platforms you have connected. You guarantee that you have the right to publish this content.
For the personal data of your guests, service providers and owners, you are the data controller and we act on your behalf: see the privacy policy and the data processing agreement, which form part of these terms.
13. Prohibited use
You may not use Orkalo to publish false or illegal listings, send unsolicited messages, collect data without a legal basis, try to access other customers' workspaces, get around technical limits or disrupt the service.
14. Availability
We do our best to keep the service available and reliable (best-efforts obligation), with regular backups. Interruptions may occur for maintenance, announced in advance where possible, or because of an incident at a provider. Planned maintenance is done, where possible, outside busy hours. Backups are taken daily and kept for 30 days; they exist to restore the service and do not replace your own exports, which we advise you to make regularly.
15. Intellectual property
Orkalo, its code, screens, texts, icons and name remain the property of the publisher. During the subscription (and the trial), we grant you a personal, non-exclusive, non-transferable right of use, limited to your activity. You do not copy, resell or disassemble the software, or mass-extract its content. Your content remains yours (article "Your content and your data").
16. Liability
We only owe a best-efforts obligation. We are not liable for: decisions or outages of the platforms and of the providers connecting us to them (refusal, suspension or closure of a listing, rule changes, interrupted connection); double bookings or price or availability gaps caused by a delay or error of these third parties; the information, prices and rules you enter; documents you produce with our templates; indirect losses (lost revenue, missed booking, lost customers, damage to reputation).
Except for gross negligence, wilful misconduct or where the law says otherwise, our total liability to you is limited to the amounts you paid for the subscription during the 12 months before the event. If you are a consumer, these limits do not apply to the extent the law forbids it.
17. Changes
We may change these terms and the prices. You are notified at least 30 days before any significant change or price increase; if you disagree, you can cancel before it takes effect.
18. Governing law and disputes
These terms are governed by French law. In case of disagreement, write to support first: we look for an amicable solution. Consumers may also use the mediator named in the legal notice. Failing agreement, the French courts have jurisdiction, subject to the rules protecting consumers.
